Hearing of application for chamber’s office materials rescheduled

KOTA KINABALU: The High Court has re-scheduled the hearing of Sabah United Chinese Chamber of Commerce (SUCCC) vice-president cum honorary secretary-general Chin Chee Kee’s application to compel the former SUCCC committee to deliver files, documents and other office materials to the current office-bearers.Justice Datuk Clement Skinner yesterday adjourned hearing to Feb 10, after allowing an application by Counsel Alex Siew, who represents former president Datuk Seri Panglima Sari Nuar and former honorary secretary-general Tan Kim Beng as defendants.

Alex applied for the hearing to be adjourned to enable him to prepare opposition affidavit to Chin’s application.

Chin’s counsel, Datuk Douglas Primus did not object to the application.

The court set Feb 8 for Alex to file the opposition affidavit while Douglas will reply on Feb 9.

The faction led by SUCCC president Datuk Kenneth Yen decided to apply for the consequential orders made by High Court Judge Datuk Clement Skinner on Dec 30 last year after they were prevented from taking over the SUCCC’s office.

Recently, Kenneth and his committee members tried to move into the SUCCC office three times but they were refused the keys to the office, documents and other office utensils.

Skinner had on Dec 30, 2009 declared the legality of the SUCCC’s election of office bearers which was held in 2007.

In his 64-page written verdict, Skinner also ordered the elected executive committee led by Kenneth to complete their two-year term with effect from Dec 30, last year

The application for the consequential orders were for Sari and Tan to hand over to Kenneth and Chin all elected executive committee all secretarial files of the SUCCC from 2002 to 2010 including all agreements entered between SUCCC and third parties; all letterheads, seals and rubber stamps of the chamber as well as all keys to the SUCCC office in Kampung Air here.

For the former treasurer general Datuk Lau Kok Sing to deliver all financial accounts from 2002 to 2010, bank statements and cheques books to the present treasurer general Chris Chang Kiaw Ngiap.

That the executive secretary Su Mei Chun delivers all office files, books, accounts, minutes of meetings and all matters pertaining to SUCCC from 2002 to 2010.
