Tribunal awards refund of RM5,000 to customer

SIBU: A tribunal court at the Ministry of Domestic Trade yesterday awarded a claimant the right to get a refund from a ‘scratch and win’ trader.

President Datuk Dr Lawrence Thien ruled that the claimant may get a refund of RM5,000 within 14 days.

During the hearing, the claimant said that the incident happened during Hari Raya Aidilfitri.

She went to the shopping mall and was approached by a salesgirl.

“She gave me a plastic container, but I refused to take it. She told me to help her out by giving my name to prove to her boss that she was actually doing her job.

“Out of sympathy, I agreed to do it and the lady gave me a card and when I opened it, it said that I had won a RM100 voucher in a lucky draw,” she said.

The salesgirl then told the claimant that she needed to buy their products in order to get the voucher.

When the claimant refused to purchase anything because she did not have any cash, the salesgirl told her to use her credit card.

Then, the salesgirl asked for the claimant’s signature without giving any chance for the claimant to ask more questions.

“She immediately asked me to sign something, without giving me a chance to see what it was and did not give me any receipt whatsoever,” she said.

The claimant had seven items in her keeping and the court ordered her to keep them until the accused has given her money back.
