Muara Tebas land owner goes to court over notice

KUCHING: The owner of a piece of land at Muara Tebas Land District yesterday sought for a review to quash a notice under Section 47 of the Land Code which affects and covers her land.

The notice was published by the Ministry of Land and Mineral Resources in the Sarawak Government Gazette on April 12, 1973.

The applicant, Maureen Song, named four defendants in the application namely Superintendent of Land and Surveys, Kuching Division, Permanent Secretary of the Ministry of Planning and Resource Management and the state government.

The 52-year-old applicant who works in Peninsular Malaysia as a clerk, had filed a statement for leave of application to quash the declaration made by the respondents last August 18, that the land is required for a public purpose.

She also applied to quash the notice issued by the respondents issued last August 30 which stated that the government intended to take possession of the said land.

The applicant said she had received a letter dated August 20 issued by the first respondent together with a Sarawak Government Gazette Notification containing a declaration made by the second respondent last August 18.

The notice said that her land was required for ‘urban development’ and the state intended to take possession of the land.

The applicant was also invited to attend an inquiry but the first respondent had failed to clarify anything about the exact development purpose of the land acquisition.

She was the registered proprietress of the land since the 1980s and in 2008 she renewed the lease for 60 years from 2008 until 2068.

The applicant was the rightful owner of the parcel of land at Sungai Buda Besar containing an area of 1.925 ha.

She was also informed about the compensation payable but she considered the amount unreasonable.

She was offered a compensation of RM40,500, which she said was based on the market price of land 37 years ago.

The proposed compensation was grossly and unreasonably low, she said.

The application was filed through Chong Chien Jien of M/s Chong Brothers Advocates yesterday.
