Jobless youth who knifed another to death to know his fate on Dec 3

SIBU: An unemployed youth who was indicted for murdering another youth with a knife two years ago will know his fate on Dec 3 when the High Court delivers its judgment.

Justice Yew Jen Kie had earlier ruled that the prosecution had made up a prima facie case against him and ordered him to enter his defence.

Given three options, Ajut Rosely preferred to make his defence on sworn evidence.

He would face the mandatory death sentence if he is convicted under Section 302 of the Penal Code.

Prior to the trial, Senior Federal Counsel Yaacub Chik told the court that the accused was charged with murdering Jimi between 6.30pm and 8.30pm in a lodging house in Kapit on July 10, 2008.

The prosecution, he said, would adduce direct and circumstantial evidence that on that fateful day, after a tattooing session at Leonard Gawai’s house and a drinking session in town, the victim had requested the accused, Leonard and Raymond Well to go to his hotel room.

In the room, he said, the accused lay down beside the victim on the bed and slashed his neck, chest and stomach.

The last stab caused the knife handle to become dislodged, leaving the blade embedded in the left side of the victim’s chest.

After that, he took a bottle and hit the victim’s head until the bottle broke. And then, he used the broken bottle to poke the victim’s body.

The cause of death was the cumulative effects of the cut to the throat and neck and stab to the heart, he said.
