Pharmacist discharged but not acquitted of ‘bad’ charge

SIBU: A pharmacist charged with recklessly making false entry in her ‘sales of poisons’ record book, was yesterday discharged but not acquitted by the Sessions Court.

Alice Lau was charged under Section 32(1) of the Poisons Act 1952, which provides for an imprisonment not exceeding two years or a fine not more than RM5,000 or both.

Under Section 32(5) of the same act, any poison would be forfeited and delivered to the director-general of health for disposal.

She was alleged to have committed the offence between August 2007 and August 2008 in her pharmacy at Lembaga Multi-storey Car Park Complex.

She was accused of having recklessly made false entry of her customers’ information in her poison sales record book.

Defence counsel Orlando Chua told the court it was not an offence to be reckless.

“I must know what I have recorded is not true or I do not believe what I have recorded to be true; only then would it become an offence,” he said, adding that the charge was ‘bad’ under the law.
