Senior citizen ordered to enter defence against molest charge

KOTA KINABALU: The magistrates’ court yesterday ordered a senior citizen to enter his defence against a charge of molesting a woman last year.

Magistrate Herlina Muse, in her reserved ruling, held that the prosecution had made out a case against Md Dini Zinoh, 71, who is defended by counsel Ebin Masalin.

The accused allegedly molested the 38-year-old woman at a lodge room in Kampung Air here at 1pm on April 25, 2009.

He is charged under Section 354  of the Penal Code which carries a maximum 10 years’ jail or with a fine or with whipping, on conviction.

The court fixed hearing to resume on Dec 1 this year for Md Dini to enter his defence.

Deputy public prosecutor Chow Siang Kong appeared for the prosecution.

In the Sessions Court, an Indonesian man received four months’ jail and two strokes of the cane for entering Sabah illegally.

Jeffry Maidin, 25, pleaded guilty before judge M Rajalingam to a charge under 6 (1) (c) of the Immigration Act 1959/63 which carries a fine of not exceeding RM10,000 or a maximum five years’ jail, on conviction.

Prosecuting officer ASP Sabrina Jinius told the court that the accused was caught at a roadside near Kingfisher on Nov 25.

In passing sentence, Jeffry was also ordered to be referred to the Immigration Department for further action as he has no valid travel document.
