Doctor freed of charge of operating clinic without licence


KUALA LUMPUR: The High Court here upheld the verdict of the Sessions Court in discharging and acquitting a doctor of a charge of operating a clinic without a licence.

Judge Datuk Ghazali Cha, in dismissing the appeal by the prosecution, said the Sessions Court judge did not err in freeing Dr R Venkatakrishnan after rejecting the exhibits submitted by the prosecution on grounds that it did not adhered to the requirement under the Criminal Procedure Code.

Ghazali said that the prosecution had also failed to provide proofs on the premises’ ownership. The Sessions Court discharged and acquitted Venkatakrishnan on April 21 after finding that the prosecution had failed to prove a prima facie case against him.

The prosecution was carried out by deputy public prosecutor Noorin Badaruddin while Karpal Singh represented Venkatakrishnan. — Bernama
