Court sets Dec 10 to decide on Measat application

KUALA LUMPUR: The High Court yesterday set Dec 10 to decide on an application by Measat Broadcast Network Systems Sdn Bhd to stay the proceedings of a suit alleging it had breached a ‘non-disclosure agreement’.

High Court Judge Datuk Azahar Mohamed set the date after hearing a submissions by Measat’s counsel N Navaratnam and AV Asia Sdn Bhd’s lawyer Firoz Hussein Jamaluddin.

AV Asia, a support equipment supplier, is suing Measat, claiming that the Astro subsidiary had disclosed confidential information to Tele System Electronic, the second defendant.

In its suit for RM1.3 billion filed on Sept 28, AV Asia alleged breach of a non-disclosure agreement on rain fade, a system to reduce disruption of satellite transmission.

Azahar also set the same day for mention of the injunction filed by AV Asia to restrain the two defendants from using its confidential information pertaining to the Astro Beyond high-definition product.

Tele System Electronic’s application to strike out the suit will also be mentioned on that day.

Meanwhile, Navaratnam had submitted that the matter should be heard in arbitration and not by the court as previously agreed under the mutual non-disclosure agreement between AV Asia and Measat.

However, Firoz said the matter could not go to arbitration because no arbitration agreement existed between AV Asia and Tele System Electronic. — Bernama
