Foreigner jailed and whipped for cheating

KOTA KINABALU: A Filipino was sentenced to two years jail and ordered to be whipped thrice by the magistrates’ court here for cheating involving RM2,000 six months ago.

Apart from that, magistrate Norhamizah Shaiffuddin also fined Jon Isnain RM5,000,in default five months’ jail after finding him guilty of cheating Runsar Isnani, 51, by asking the latter to give him RM2,000 bail to release Runsar’s brother-in-law who was allegedly involved in a narcotic case at a Kota Kinabalu court here at 10am on Jun 30.

Norhamizah, in her reserved judgement, held that the prosecution had proved its case beyond reasonable doubt.

The 31-year-old accused was charged under Section 420 of the Penal Code which carries a jail term of not less than one year and not more than 10 years or a fine or whipping, on conviction.

Deputy public prosecutor (DPP) Uma Devi Balasubramaniam had called four witnesses to testify against Jon since the trial commenced on Oct 27 this year.

This case was first brought on July 14 this year. DPP Wan Azwan Aiman Wan Fakhruddin stood in for Uma Devi.

In another Magistrate’s Court, a local man was jailed 36 months on two counts of cheating two local men involving RM700.

Marsidi Ahmad pleaded guilty before magistrate Nuruhuda Mohd Yusof to both the charges yesterday.

For the first count, the accused was jailed for one and a half years for cheating Rais @ Zulkifli Sinsani by offering the latter four car tyres valued at RM200 and induced Rais to give the accused RM200 at a shop at the Bandaran Berjaya here on Oct 15.

For the second charge, Marsidi was jailed for another one and a half months for cheating Harlin Harun by making the latter believe that there were two laptops belonging to Customs Department which can be sold cheaply and induced Harlin to give Marsidi RM500 as a payment for both the laptops at a restaurant at the Bandaran Berjaya here on Nov 3.

In passing sentence, Nuruhuda ordered Marsidi’s jail term to run concurrently and also ordered him to be placed under police supervision for two years.

Prosecuting officer Chief Inspector Lim Swee Beng appeared for the prosecution.
