No evidence, so DVD peddler gets off scot free

KUCHING: A 33-year-old man was discharged and acquitted in the magistrates’  court from the charge of selling illicit DVD, yesterday.

The presiding magistrate Iris Awen Jon ruled that the prosecution had failed to prove a prima facie case against the accused, Ting Kock Kin.

He was alleged to be  selling 1020 DVDs with no ‘B’ label and 58 pornographic DVDs at RH Plaza near Jalan Stutong, at about 6.10pm on April 27. The prosecution had failed to prove that the DVD belonged to Ting and there is no transaction evidence on the selling and buying of the DVDs.

The offence comes under Section 18 (4)(a)  and 5(1)(a) of the Film Censorship Act 2002. Counsel Lim Lian Kee defended Ting.
