Fed Court upholds death sentence on restaurant operator

PUTRAJAYA: The Federal Court here yesterday upheld the conviction and death sentence on a restaurant operator for trafficking 1,032g of cannabis 11 years ago.

The three-man panel comprising Chief Judge of Malaya Tan Sri Arifin Zakaria and Federal Court judges Tan Sri Mohd Ghazali Mohd Yusoff and Datuk Heliliah Mohd Yusof unanimously dismissed the final appeal by Mohd Farid Sukis.

Mohd Farid, 35, had appealed against the decision of the Court of Appeal which had convicted him and imposed the death sentence for trafficking the drug at a house in Kampung Batu Muda, Jalan Ipoh, Sentul, in the
Federal Territory of Kuala Lumpur at about 11am on Oct 9, 1999.

In handing down the Federal Court’s decision, Arifin said the Court of Appeal was right in its decision to accept the prosecution’s appeal to set aside the Kuala Lumpur High Court’s acquittal and discharge of Mohd Farid on 28 June 2002.

According to the testimony of the arresting officer, Insp Wan Azlan Wan Mamat, Mohd Farid was squatting and slicing a slab of cannabis with a knife when police raided the house.

Mohd Farid was represented by counsel T Suresh while deputy public prosecutor Tengku Amir Zaki Tengku Abdul Rahman appeared for the prosecution. — Bernama
