Short-lived freedom for teens in hand phone theft

KUCHING: Two youths yesterday pleaded guilty in the magistrates’ court to robbing a 12-year-old girl of her hand phone.

The boys also caused hurt to the victim when committing the robbery in July last year.

The 15-year-old youth appeared before Magistrate Atikah Abdul Karim who fixed a probation report on Feb 11 for sentencing the accused.

Earlier, both accused appeared before a Sessions Court judge for the trial and were discharged, but not amounting to acquittal.

Judge Amelati Parnell delivered the decision.

The complainant, who is also the victim, did not appear yesterday.

However, it was only a short freedom for both accused as they were charged again in the magistrates’ court.

Originally, three accused were charged with robbery under Section 395 of the Penal Code.

However, the first accused failed to turn up for the trial scheduled before Amelati yesterday.

Both accused admitted committing the robbery and causing hurt to the girl near Hainan cemetery at Mile 5, Penrissen Road between 2pm and 4pm on July 21 last year.

The offence comes under Section 394 of the Penal Code read together with Section 34 of the same code which carries a maximum penalty of 20 years’ imprisonment and liable to a fine and whipping upon conviction.

Chief Inspector Carl Patrick Ramesh appeared for the prosecution while both accused were unrepresented.
