PKFZ scandal: Court sets Jan 28 to hear CEO’s application

SHAH ALAM: The Klang Sessions Court which sat here yesterday postponed to Jan 28 the hearing of an application by Kuala Dimensi Sdn Bhd Chief Operating Officer Stephen Abok to strike out all the 26 alternative charges preferred against him in connection with the Port Klang Free Zone (PKFZ) scandal.

Judge Asmadi Hussin set the date after Stephen’s counsel Hisham Teh Pok Teik requested for time to file the reply to the affidavits which were received from the prosecution last Wednesday.

Stephen had filed the application to strike out the charges on Dec 29 last year.

Hisham also told the court that they were waiting for the reporter who wrote the article, OSK Trustees unaware of Cheating in PKFZ Case, published by The Edge Financial Daily on Nov 10 last year to file an affidavit saying the reporter was the writer of the article, and that a letter was sent to the editor-in-chief of the financial newspaper on Jan 7 to seek the cooperation of the reporter in the matter.

Head of the Forfeiture of Property Unit in the Prosecution Division of the Attorney-General’s Chambers, Dzulkifli Ahmad, who heads the prosecution, told the court he had no objection to the postponement but asked for the hearing dates to be set.

Asmadi set the hearing dates for March 29 and 30, April 12 to 14 and April 26 to 28 this year.

Law Jenn Dong, 52, former KDSB project manager and architect Bernard Tan Seng Swee, 49, of BTA Architect, had pleaded not guilty on Nov 8 this year to 24 alternative charges of cheating OSK Trustees Bhd, involving payment of RM116.85 million to KDSB for two projects at PKFZ.

They were alleged to have committed the offences at OSK Trustees Bhd, Plaza OSK Ampang between June 30, 2006 and June 20, 2008.

The three men are charged with cheating and dishonestly inducing OSK Trustees to believe that the electrical infrastructure works of a 33kv system for PKFZ, Pulau Indah, had been implemented when they knew it was not.

Law, Stephen and Tan are also charged with cheating OSK Trustees into believing that the 33kv system to Precinct 2 and Precinct 8 for the PKFZ project had been implemented when they knew that it was not. — Bernama
