Gang rape case adjourned as report not ready yet

KUCHING: A magistrate’s court here yesterday adjourned the case where a lorry driver for a council and a security guard were accused of the gang rape of an 18-year-old college student.

The case, supposed to be heard on Dec 5 and 7, has been adjourned to Jan 9 and 10 next year as the complete report on the case was not out yet.

Lorry driver Koken Ham, 40, and security guard, Amor Singit, 45, were charged under Section 376 (b) of the Penal Code for rape which provides for a maximum 30 years’ imprisonment and whipping upon conviction.

Amor also faced another charge of attempted rape of the girl in an abandoned house at Jalan Bampfylde near here.

He will be tried under Section 376 (b) read together with Section 511 of the Penal Code.

Koken and Amor from Desa Wira and Kampung Tematu respectively, with one person still at large, impersonated police officers on the pretext of checking the identity cards of the girl and her boyfriend in a garden at MJC Batu Kawa at about 1.30pm.

When the boy could not produce his MyKad, he was asked to go home to get the document while the girl was held to ensure his return.

Upon returning, the boy could neither find his girlfriend nor the men in the garden, so he headed to Batu Kawa Police Station to make a report.

Later, he received a call from his girlfriend and learnt that she had been forced into a car and brought to a cemetery in Petra Jaya where she was raped.

The rape by the trio took place under a tree near a pond at a cemetery along Jalan Sultan Tengah between 2am and 4.45am on Oct 6.

She was also brought to an abandoned house at Bampfylde Road and once again raped before being released.

The boyfriend and a team of policemen went to pick up the girl after being informed of her whereabouts.
