‘Borneonisation’ case on July 23

KOTA KINABALU: The High Court here yesterday fixed July 23 as the next mention date in the “Borneonisation” case.

Retired police inspector Bernard Fung Fon Chen, 70, and ex-teacher Mohd Nazib Maidan Dally, 35, brought the case against the federal and Sabah governments for allegedly failing to implement the Borneonisation of the public service in Sabah as promised in the Malaysia Agreement 1963 and the Inter-Government Committee Report.

Justice Datuk David Wong Dak Wah has also given the defendants until July 18 to file their affidavits in opposition.

The Kota Kinabalu High Court had on May 25 dismissed the application of the federal and state governments to strike out the “Borneonisation” suit, ruling among others that the plaintiffs had the right and the locus standi to come to court for the court to decide whether the government had failed to implement the undertakings and assurances contained in the Malaysia Agreement 1963. Counsel for the Sabah government yesterday informed the High Court that the state government was appealing against the court’s dismissal of the government’s application to strike out the suit.

Puan Nur Aimi Binti Arazmi appeared for the federal government while Mohammad Bin Abd Sani appeared for the state government.

Present in court were lawyer for the plaintiffs, Peter Marajin, with Nazib Maidan and Likas assemblyman Datuk Liew Teck Chan who is also SAPP deputy president, and other SAPP members who came to show moral support.
