CBT: Man acquitted, discharged

KOTA KINABALU: The Sessions Court here freed a local self-employed man from a charge of committing criminal breach of trust (CBT).

High Court deputy registrar Noor Hafizah Mohd Salim acquitted and discharged Robert Rajah Junior @ Bob, 47, without calling for his defence.

Noor Hafizah who presided as the Sessions Court judge, ruled that the prosecution had failed to establish a prima facie case against the accused.

Robert was entrusted with RM21,550 in cash by his employer to buy a bank draft at a bank in Jalan Gaya here at 2.44pm on September 23, 2010 as a deposit to the Local Government and Housing Ministry. However, he allegedly used the money for himself.

The charge under Section 408 of the Penal Code, carries a maximum 14 years’ jail and whipping and also liable to a fine upon conviction.
