Jail and whipping for two armed robbers

KOTA KINABALU: A local and a foreigner were each jailed for five years and ordered to be whipped once by the Sessions Court yesterday for armed robbery.

The deputy registrar of the High Court Noor Hafizah Mohd Salim, who sat as a Sessions Court judge, meted out the sentence on Fauzi Baharom, 25, and Ramlan Hassan, 36, after they pleaded guilty to a charge under Section 395, punishable under Section 397 of the Penal Code, which carries a maximum jail term of 20 years and also liable to whipping, upon conviction.

Fauzi and Ramlan had both robbed a local male cashier of RM5,000 in cash, two cellphones, several packets of cigarettes and other grocery items at a shop in Inanam on June 15.

The duo with an accomplice, who is still at large, were armed with a knife when they committed the robbery.

Deputy public prosecutor Aida Jaafar Mad Ariff told the court that during the incident, the two accused persons had entered the shop and demanded for money from the cashier at knife-point.

Both had threatened to stab the cashier in the event he refused to hand over the cash.

Fearing for his life, the victim gave them all the cash which were kept inside a drawer, Aida added.

Additionally, Noor Hafizah also issued an order for Ramlan, who is an illegal immigrant, to be referred to the Immigration Department after serving his jail term for deportation to his country of origin.

Meanwhile, Abdul Min Edilis, 22, claimed trial to a charge of robbing and causing hurt to a teenager.

The accused who was brought to appear before the deputy registrar of the High Court Amir Shah Amir Hassan faced a charge under Section 394 of the Penal Code for robbing a 18-year-old girl of a cellphone worth RM800 and for stabbing her with a knife at a shop in Segama on June 16.

The provision provides for a jail term of up to 20 years and also liable to whipping, upon conviction.

Amir Shah, who presided as a Sessions Court judge, fixed Sept 5 this year for Abdul Min’s trial and released him on a bail of RM10,000 deposited with RM5,000 with two local sureties, pending his trial.
