Local to know fate July 6 over rape of minor

KOTA KINABALU: The Sessions Court here will decide on Friday on the case of a local man charged with raping a minor.

Judge Ismail Brahim set the date to deliver his judgement for Azrin P. M. A Sahabudden when the case came up for review of the warrant of arrest against the latter.

The court also ordered Azrin’s bail to be forfeited and the accused to be remanded under Section 259 of the Criminal Procedure Code pending disposal of the case.

Yesterday, Azrin was produced in court after he was re-arrested by police in Sinsuran here on June 28.

The court had on June 19 issued a warrant of arrest against Azrin after he failed to appear in court for the judgement on the case.

Azrin allegedly raped the girl, who was then 15 years and six months old, in a room of a lodging house in Sinsuran 2 here about 2pm on June 2, 2011.

He is tried under Section 375 (g) of the Penal Code, which provides for a jail term of up to 20 years and whipping on conviction.

The trial started on September 19, 2011 with the prosecution calling a total of six witnesses before closing its case.

On April 23, the court ordered the accused to enter his defence after ruling that the prosecution had established a prima facie case against him.

The accused gave a sworn statement in his defence on May 3.
