Ex-policeman’s jail, rotan sentence for rape upheld

KOTA KINABALU: The High Court here yesterday upheld the sentence of 18 years’ jail and 15 strokes of the cane handed down to a former policeman for raping his daughter.

Chief Justice for Sabah and Sarawak, Tan Sri Richard Malanjum, who presided as a Sessions Court judge, dismissed the 57-year-old man’s appeal to have his sentence reduced.

The former policeman, who was defended by counsel Hamid Ismail, was convicted under Section 376 (3) of the Penal Code which carries a maximum jail of 30 years and also liable to whipping, upon conviction.

He was found guilty of raping his daughter, aged 14, on July 6, 2012, inside a Proton Saga car in Kota Marudu during the year end school holidays in December 2009.

In an unrelated case, the magistrates’ court here transferred the drug trafficking case of a man from Selangor to the High Court.

Magistrate Edward Paul made the order at the request of Customs Department’s prosecuting officer Janet S Linggu.

Linggu told the court that she has received instruction from the deputy public prosecutor’s office to transfer the case of 31-year-old Mohd Rizal Kamamruddin to the High Court. A chemist report showed that the weight of the drug was 2,850.60g.

Mohd Rizal was accused of trafficking in the drug Amphetamine at Terminal Two of the Kota Kinabalu International Airport here at 9.30am on Nov 18, 2012.

He faces the mandatory death sentence if found guilty of the offence under Section 39B (1) (a) of the Dangerous Drugs Act 1952.

Previously, the accused was charged with trafficking in 4,018g of the drug.
