KOTA KINABALU: The Sessions Court here would decide today on the dates for resumption of a Pakistani trader’s trial for causing the death of a 16-year-old Kota Marudu girl five months ago.

Judge Duncan Sikodol yesterday deferred the case of Amir Ali Khan Nawaty, 40, after deputy public prosecutor (DPP) Raja Zaizul Faridah Raja Zaharuddin informed that counsel Rakhbir Singh could not attend court’s proceedings.

Raja Zaizul Faridah said she had contacted Rakhbir who informed her that his mother was sick.

The accused allegedly committed culpable homicide not amounting to murder of Norikoh Saliwa in a moving lorry at Jalan KM2.8, Langkon-Kota Marudu road between 11am and 12.30pm on Nov 25, 2012.

The charge was framed under Section 304 (b) of the Penal Code which carries a jail term of up to 10 years or a fine or both, upon conviction.

Amir Ali was ordered to be further held in custody, pending disposal of his case.

Raja Zaizul Faridah was assisted by DPP Afzan Abdul Kahar.
