Man ordered to enter defence over rape of sister-in-law

KOTA KINABALU: The Sessions Court here yesterday ordered a local man, who was charged with raping his sister-in-law, to enter his defence on June 21 this year.

Judge Ismail Brahim meted out the decision to the 66-year-old accused after he ruled that the prosecution had established a prima facie case against him.

The accused, represented by counsel Batholomew Jingulam, was accused of raping the 33-year-old victim at a house in a village in Papar on Oct 31, 2011.

The offence was framed under Section 376 of the Penal Code which provides for a maximum jail of 20 years and also liable to whipping, upon conviction.

Deputy public prosecutor Nartiah F. Mirchelle Sambatan had called 10 witnesses to testify against the accused.
