Application by five artistes for default judgment dismissed

KUALA LUMPUR: The High Court here yesterday dismissed an application by five veteran artistes to enter a judgment in default against Persatuan Seniman Malaysia (Seniman) and seven others in a suit over the association’s 15th annual general meeting which they claimed was null and void.

Judge Rosilah Yop made the decision in chambers in the presence of lawyers Majdah Muda, representing the five artistes, and Suhaimi Saad, representing Seniman and seven other defendants.

Majdah told reporters that the court also dismissed an application by the five artistes to set aside the defence filed by the defendants.

“The court dismisses both the applications by the plaintiffs on grounds that there were issues to be tried,” she said.

The court set Oct 2 to 4 to hear the case.

Abu Bakar Omar, Sahlan Sudiran, Mior Ahmat Zaudi Mior Ali, Datuk Abdullah Sani and Roslinda Buang as the plaintiffs had filed the suit last Feb 22 claiming that Seniman’s previous AGM was not in order.

The had named Seniman, its president then Haron Aminar Rashid Salim or better known as Harun Salim Bachik, secretary Omar Kamarudin (better known as Yusof Kelana), treasurer Wafa A Kadir and Zed Zaidi (real name Rozaidi Abdul Jamil), who was the deputy president then, as the defendants.

The three others were Seniman executive committee members Elyas Ismail, Syed Ahmad Nahar Syed Mokhtar and Zaharudin Wahab.

They had wanted the court to declare that Seniman’s 14th AGM held on May 26, 2012, the Financial Report for 2011 and minutes of the AGM, as null and void.

They claimed that besides that of the plaintiffs and defendants, there were doubts as to the legitimacy of the membership of hundreds of others who attended the AGM.

They also sought a declaration that the election of office bearers at the 2012 AGM was not valid, damages and other relief deemed fit by the court.

Besides these, they also wanted Harun Salim Bachik, Yusof Kelana and Wafa to pay RM56,000 to the association for allegedly causing it to suffer losses over a property transaction. — Bernama
