Businessman charged with threatening Customs officer

KOTA KINABALU: A Johor businessman claimed trial in a Magistrate’s Court here yesterday to two counts of threatening a Customs Department senior assistant director and committing mischief on his car.

On the first count, Lee Chin Yong, 35, who appeared before magistrate Cindy Mc Juce Balitus, was alleged to have threatened the victim by pointing a wooden plank on him in front of the Wawasan Plaza traffic lights here at 9.10pm on September 27.

The offence was framed under Section 506 of the Penal Code which provides for a maximum jail of seven years and a fine or with whipping, upon conviction.

For the second charge, Lee, who was represented by counsel P.J Perira, was accused of smashing the windshield of the victim’s car at the same time and place.

Lee was charged under Section 427 of the Penal Code which provides for a maximum jail of two years or a fine, or both, upon conviction.

The court fixed November 14–15 this year for the trial of the case and released him on RM2,500 bail with two local sureties for each of the charges, pending disposal of the case.

Prosecuting officer Inspector Azaman Hamat prosecuted.

The same court sentenced a foreigner to 14 days’ jail and fined him RM25, in default, seven days’ imprisonment for unruly behaviour at a department store.

Magistrate Cindy imposed the sentence and fine on Mohd Noh Sani, 29, after he pleaded guilty to the charge.

He admitted to being publicly drunk at a departmental store in Centre Point and acting in a disorderly manner on Oct 6 around 3.45pm.

The offence under Section 15 of the Minor Offences Ordinance carries a maximum fine of RM25 and imprisonment up to 14 days on conviction.

Prosecuting officer Inspector Azaman Hamat told the court that a worker at the store had noticed the accused drunk.

The accused then purposely knocked the complainant and a quarrel ensued between the two of them.

The complainant, with a help of a friend, managed to catch the accused and reported him to the police.
