Court of Appeal upholds 10 years’ jail and whipping for liquor six robbers

PUTRAJAYA: The Court of Appeal here yesterday upheld the conviction and 10 years’ jail and five strokes of whipping imposed on six men for robbing liquor worth about RM1.25 million at a warehouse in Port Klang, about eight years ago.

A three-member panel led by Justice Datuk Abdul Aziz Abd Rahim unanimously dismissed the appeals brought by V Anbalangan, 43, G Ravichandran, 35, S Mogan, 42, S Paramasivam, 39, M Anpalagan, 38 and P Suresh, 34, to set aside a sessions court decision on the case.

The same panel set two other men — K Murugan, 32 and V Prakas, 34 — free after allowing their appeals and acquitted them on a similar charge.

Abdul Aziz held that the convictions of the two men were unsafe as their identification was in question.

He then set aside the Klang Sessions Court’s decision to convict and sentence the duo to 10 years’ jail and five strokes of whipping.

Meanwhile, the panel, also comprising justices Datuk Rohana Yusuf and Datuk Seri Zakaria Sam, struck out an appeal by Myanmar national Tin Myo Minn, 34, who failed to turn up in court.

The panel also issued a warrant of arrest and warrant of committal against Tin.

The nine were charged with robbing liquor while armed with knives and axes, at Gudang Jasa Kita SVC Sdn Bhd, Lot 5, Kawasan 20, Solok Sultan Hishamudin 1, Bandar Sultan Sulaiman, Port Klang, between 1.30am and 4.30am on Oct 24, 2005.

They were alleged to have committed the offence, together with four others still at large.

On Oct 4, 2010, the Klang Sessions Court found them guilty on the charge and sentenced them to 10 years’ jail and five strokes of whipping.

They appealed to the Court of Appeal after the high court in Shah Alam dismissed their appeals on Aug 16, last year. — Bernama
