ALOR SETAR: The High Court here yesterday acquitted and discharged a factory operator on a charge of trafficking in drug, allegedly committed three years ago.

Judicial Commissioner Datuk Zakiah Kassim ordered Ahmad Fauzi Ismail, 36, to be freed after finding that the prosecution had failed to establish a case against the accused.

Ahmad Fauzi was charged with trafficking in 6,782.8 grammes of methamphetamine at a car park in front of the Kubang Pasu district police headquarters in Jitra at about 9.30am on Aug 5, 2011.

He was initially charged with committing the offence with his wife, Faizah Hamzah, 39, in Kulim, but the wife had been acquitted and discharged, without calling for her defence, on Oct 23, last year.

The charge carries the mandatory death sentence upon conviction.

Prosecution was conducted by deputy public prosecutor Siti Aishah Abd Rashid, while Ahmad Fauzi was represented by lawyer Datuk Naran Singh. — Bernama
