Molest accused fails to show up in court for third time

KOTA KINABALU: The High Court here yesterday fixed September 30 this year for the final review of an arrest warrant of a man who was convicted of kissing a teenage girl’s hand and neck last year.

Judicial Commissioner Gabriel Gumis granted the extension of the warrant of arrest issued on Muhammad Rasan Gul Shad, 51, at the request of the prosecution.

Deputy public prosecutor Afzan Abd Kahar told the court that the respondent still did not appear in court yesterday when the case came up for review of his arret warrant.

The respondent, who was unrepresented, failed to turn up in court for the third time and his warrant of arrest was first issued on March 27.

On December 17, 2014, Muhammad was fined RM3,000, in default, six months’ imprisonment by the lower court here after he admitted to molesting the 15-year-old girl at a house at a village in Putatan on December 12, 2014.

He was convicted under Section 354 of the Penal Code which carries a jail term of up to 10 years or with a fine and whipping upon conviction.

In a separate case, the Magistrate’s Court here transferred a drug trafficking case of a man to the High Court.

Magistrate Cindy Mc Juce Balitus transferred the case of Kho Kang Yau after Customs Department prosecuting officer Janet S. Linggu informed that the drug analysis report is ready.

The accused was alleged to have trafficked in 1,996.6 grams of syabu at the arrival hall of Terminal 2, Kota Kinabalu International Airport on March 6.

The 26-year-old accused was charged under Section 39B (1)(a) of the Dangerous Drugs Act 1952 which provides for the mandatory death sentence upon conviction.

This case was first brought to court on March 20.
