Civil servant jailed for credit card fraud

KOTA KINABALU: A government servant was jailed for one year by the Magistrate’s Court here yesterday for cheating by impersonation in order to activate a credit card.

Faizal Hassan, 40, pleaded guilty before magistrate Cindy Mc Juce Balitus to a charge under Section 419 of the Penal Code which provides for a jail term of up to seven years or a fine or both, upon conviction.

He admitted to cheating a bank in Kuala Lumpur by impersonating as one Mohamad Azam Arshad, 32, for the credit card activation in order to use it.

The offence took place at the Malaysian Maritime Enforcement Agency (MMEA) at Wisma Sedco Industrial Estate here on August 11, 2005.

Prosecuting officer Inspector Isfandiar Dr. Jasdi told the court a banker from Kuala Lumpur went to see the complainant over RM3,606.90 spent using a credit card under the complainant’s name, but the complainant said he had never applied for the the credit card in question or used it.

Based on a closed circuit television set at the complainant’s office, it showed that the person was the complainant’s workmate (the accused).

Investigation revealed that the accused had made a withdrawal at an auto teller machine in Likas and later bought a gold necklace.

When asked by magistrate why he did that, the accused explained that his wife was pregnant and he bought the necklace for the purpose of selling it back.
