Man denies raping his 13-year-old daughter

KOTA KINABALU: A 42-year-old father claimed trial at the Sessions Court here yesterday to three charges of raping his daughter.

The accused, who was brought before judge Ainul Shahrin Mohamed, was charged under Section 376 (3) of the Penal Code for incestuous rape, which carries a jail term of up to 30 years with whipping, upon conviction.

He was alleged to have raped the 13-year-old girl at a house in a residential area in Manggatal here between November 2015 and February 2016.

In applying for bail, counsel Alex Lee, who represented the accused, told the court that his client was an air-conditioner technician and was a breadwinner with four children.

He also prayed that the accused’s siblings, who were present in court yesterday, to stand as local sureties in the bail application.

Meanwhile, deputy public prosecutor Hafizah Zahidah Abdullah objected to bail as the offence is a non-bailable offence, which was committed on his own family.

The court fixed pre-trial case management on June 13 this year and the accused was further detained under Section 259 of the Criminal Procedure Code, pending disposal of the case.

In a separate case, the same court fixed September 21-23 this year for the trial of Sapirin Ahmat, 41, for attempted rape under Section 376 (1) of the Penal Code and read together under Section 511 of the same Code.

The indictment provides for a maximum prison term of 10 years and whipping on conviction.

Sapirin was alleged to have raped a 21-year-old woman at a helicopter landing area in Ranau at 2.30pm on March 18, 2009.

The court also released the accused, who was represented by counsel Michelle Usman, on RM10,000 bail with two local sureties, pending disposal of his case.
