Jailed for impregnating his daughter-in-law

TAWAU: A 54-year-old local man was sentenced to a total of 18 years’ jail by the Sessions Court here yesterday for incest with his 40-year-old daughter-in-law.

Judge Egusra Ali meted out the sentence on the accused to three years’  jail for each of six counts under Section 376B(1) of the Penal Code which carries a jail term of not less than six years and not more than 20 years and with whipping.

On the first count, the accused was charged with raping the daughter-in-law between February 1, 2010 and February 6, 2010 at about 1am in an unnumbered house at Kg Labuan Senang, Semporna, while his wife was at a fish farm.

On the second count, the accused was charged with the same act between February 14 and February 20 at about 1am, while on the third count, he was accused of committing the act between February 28 and March 6 at around 1am at the same house.

The victim married the accused’s son in 1992 and they have four children aged between five and 13.

Her husband, a fisherman, drowned on October 1, 2009 and the victim continued to stay with the in-laws.

She was afraid to report the matter as the accused had threatened her with a machete, but a report was lodged after she became pregnant and gave birth to a child.

Deputy Public Prosecutor Mohamad Safarizan Zakaria prosecuted the case.
