Man charged with using fake forms, letters

KOTA KINABALU: A 67-year-old man, who was charged with four counts of dishonestly using as genuine fake share transfer forms and resignation letters, will stand trial on October 23 and 24 this year.

Ling Tiong Chai, who appeared before magistrate Jessica Ombou Kakayun, was charged under Section 471 of the Penal Code, punishable under Section 465 of the same Code.

The indictment carries a jail term of up to two years or with a fine, or both, upon conviction.

On the first to the second charges, Ling was accused of using as genuine the 32A forms to transfer the share of Abdul Rahman @ Abdul Rahman Khan @ Abdul Rahman Ashraff, 77, to Maria Theresa Yong Abdullah amounting to RM291,501 and another RM150,000 to Sitilah Gillod at a company here on August 15, 1996 and April 16, 2000, respectively.

On the third and fourth counts, he was alleged to have used as genuine “Resignation as Director” letters under the name of Abdul Rahman at the same place on June 26, 2000 and April 16, 2001, respectively.

Ling is currently released on RM10,000 bail for all the charges with two local sureties, pending disposal of his case.

Meanwhile, six foreigners were jailed between four and five months by the Sessions Court here yesterday for illegal entry into the state.

Ibut Salie,  Alano Halid,  Salleh Jas, Amir Birullah , Al Basir Bajil and Nida Radjilol Abdurajik, who appeared before judge Azreena Aziz, pleaded guilty to each of their charges under Section 6 (1) (c) of the Immigration Act which carries a fine not exceeding RM10,000 or jail a term of up to five years and liable to whipping, on conviction.

The judge also ordered Alano, Salleh, Amir and Al Basir to be given a stroke of the cane while others were spared due to their gender and age.

The foreigners were arrested between April 29 and June 11 in Tuaran and here, after failing to show proper travel document during an inspection.

All of the accused were also ordered to be referred to the Immigration Department after serving their sentences for their biometrics data to be recorded before deportation.
