KOTA KINABALU: A 46-year-old man from China was fined RM4,000, in default two months’ jail by the Sessions Court here yesterday for entering Sabah illegally.

Judge Noor Hafizah Mohd Salim imposed the sentence on Luo Benxi after he pleaded guilty to a charge under Section 6 (1)(c) of the Immigration Act 1959/63.

The indictment carries a maximum fine of RM10,000 or a jail term of up to 12 months and not more than six strokes of the cane, upon conviction.

He was caught without valid visit pass to enter the state at Luo Chinese Medicine Qigong Sdn Bhd, Damai Plaza in Luyang at 10.39am on July 6.

Prosecuting officer from the Immigration Department, Juachim Abel Majain, told the court that the accused had entered Sabah via Labuan without any visit pass.

He also said the accused only possessed a working pass which was valid in Peninsular Malaysia until 2018.

In pleading for a lenient sentence, Luo told the court that his wife was currently sick and wanted to go back to his country as soon as possible.

The court also ordered Luo to be referred to the Immigration Department after serving his sentence.
