Elderly woman claims trial to causing death

KOTA KINABALU: An elderly woman claimed trial in the Sessions Court here yesterday to a charge of causing the death of an old lady.

Chin Su Ching, 64, who appeared before judge Azreena Aziz, was alleged to have committed culpable homicide not amounting to kill Ngui Lim Kiau also aged 64 at a house in Kepayan on September 23, 2016.

The charge, read to the accused in Hakka, was framed under Section 304 (a) of the Penal Code which is punishable by a jail term of up to 30 years and a fine, upon conviction.

On September 29, the prosecution had offered the lesser charge to the accused, who initially faced the capital punishment under Section 302 of the same Code for allegedly killing the victim at the same time and place.

The accused, who was represented by Messrs J. Ambrose and Partners, was denied bail and her case will be mentioned again on November 3 for case management.

Meanwhile, the Corruption Court here ordered a policeman from Sarawak to enter his defence on a charge of corruptly receiving RM500 from a woman.

Judge Abu Bakar Manat made the decision on Lance Corporal Awang Mohamad Awang Sahari, 40, after the judge ruled that the prosecution had established a prima facie case against the accused.

The charge stated that the accused, who was defended by counsel Goldam Hamid, had received the bribe from Meriam Husin inside a car in Lorong Ceri here between 1pm and 2.30pm on March 11, 2010.

Awang Mohamad had allegedly received the money as an inducement to not take action against Meriam and another man, Jhon Cleent Leonie who did not have any valid travel document at the time.

The court fixed November 6-17 this year for the accused to enter his defence.

The prosecution had called 30 witnesses to testify against the accused during the trial.
