Death sentence on man for killing brother-in-law upheld

PUTRAJAYA: The Court of Appeal yesterday upheld the death sentence by hanging on a former driver with a government department in Putrajaya for killing his brother-in-law on the fourth day of Aidilfitri, five years ago.

A three-man bench chaired by Justice Datuk Rohana Yusuf made the decision after dismissing the appeal by Khairul Nordin, 46, against his conviction and sentence handed down by the Melaka High Court on Jan 27, 2017.

She said the panel had unanimously found that the High Court judge had not erred at all in her judgment.

“The conviction and sentence by the High Court judge are safe.Therefore, the conviction and sentence are upheld,” said Justice Rohana who set together with Justices Datuk Yaacob Md Sam and Datuk Rhodzariah Bujang.

The Appeals Court made the decision after hearing submissions from lawyer Asmawi Ismail, representing the appellant  (Khairul), and deputy public prosecutor Nurinna Bahadun, who appeared for the prosecution.

Melaka High Court judge Datuk Zulkifli Bakar had passed the death sentence on Khairul after he was found guilty of murdering his brother-in-law Abdul Rashid Ahmad, 48, at the compound of house, Lot  115A,  KM18, Kampung Serkam Pantai, Merlimau, Jasin, Melaka  at 8pm on Aug 22, 2012.

He was charged under Section 302 of the Penal Code which provides for the mandatory death sentence. In the incident, Abdul Rashid, a welder, had admonished his brother-in-law Khairul for always physically abusing his wife (Abdul Rashid’s sister).

Khairul became angry and a fight ensued between him and Abdul Rashid, where Khairul took a knife and fatally stabbed him. Khairul fled the scene and went missing for a year before he was arrested on Oct 18, 2013 in Seremban, Negeri Sembilan. — Bernama
