KOTA BHARU: An unemployed man was ordered sent to the gallows to be hanged to death by the High Court here yesterday after he was found guilty of murdering a housewife in 2015.

Judicial Commissioner Datuk Ahmad Bache also sentenced Mohammad Awari Ahmad, 25,  to 18 years’ jail and 12 strokes of the cane for raping the woman.

Mohammad Awari  was charged with murder-cum-rape of Yashmin Fauzi, then aged 25, at a house in  Kampung Batu Papan, Gua Musang, between 12.20am and 2am on March 1, 2015.

He was charged under Section 302 of the Penal Code, which carries the death sentence upon conviction, for murder, and under Section  376(4) of the same law for causing the death of the woman while raping her.

In the judgment, Ahmad said the court could not accept the excuse by the accused that he had no intention of murdering the victim as investigation revealed there were two slash wounds on the victim’s neck.

“The victim’s son, then aged five, when called to testify, also claimed that his mother was slashed on the neck.

“There was also an intention to cause harm by the accused because he had changed the piece of wood to a machete after breaking into the house,” he said.

Deputy public prosecutor Shaharaliza Ab Razak prosecuted, while Mohammad Awari was represented by lawyer  Latifah Ariffin. — Bernama
