Man fined RM3,000 for a charge of outraging modesty of woman

KUCHING: A Magistrate’s Court here yesterday fined a man RM3,000 in default eight months in jail after he pleaded guilty to outraging the modesty of a woman.

Allhamulana Kederi, 43, committed the offence on May 14 at 4.30am in a house at Jalan Matang here, when he used criminal force with intent to outrage the modesty of the 36-year-old victim, who was sleeping in the living room of the house.

He was charged under Section 354 of the Penal Code, which provides for an imprisonment term of up to 10 years, a fine, caning, or any two of such punishments.

According to the facts of the case, the complainant said she awoke after the accused kissed her on her right cheek.

She found Allhamulana sitting by her side, leading her to shout for her mother, who woke up and switched on the light.

The victim filed a report at the Gita police station the next day and Allhamulana was arrested.

In the same courtroom, a man was fined RM1,000 in default one month in jail after pleading guilty to making a false police report.

On May 20, Muhammad Fizdaus Abdul Kadir, 27, falsely reported that a motorcycle was stolen from his house.

Traffic police had in fact confiscated the motorcycle while carrying out an operation on May 19 and it was impounded at the Kuching District police station.

Muhammad Fizdaus filed the false police report because the motorcycle belonged to his employer and he wanted to avoid having his employer take action against him for losing company property.

Making a false report to a public servant contravenes Section 182 of the Penal Code, which provides for up to six months in prison, a maximum fine of RM2,000, or both.
