Conviction against twin brothers upheld, sentence reduced

KUALA LUMPUR: The High Court here yesterday upheld the conviction for robbery on a pair of twin brothers, but reduced their jail sentence to five years, from seven years previously.

Judge  Datuk Azman Abdullah made the decision after allowing an appeal by A Thanabalan and A Thanaselan, 21, against their conviction and sentence handed down by a Sessions Court on Dec 28 last year.

The prosecution also appealed against the sentence.

In reducing the jail sentence, Azman upheld the two whipping meted out against the twins by the Sessions Court.

“You are still young. Hopefully, with this punishment, both of you will be remorse and become better persons,” he added.

The twins were sentenced to seven years jail and two strokes of the cane each by the Sessions Court after finding them guilty of robbing a Bangladeshi student.

Thanabalan and Thanaselan, together with two others still at large, were charged with robbing Kawser Ibne, 23, of his handphone and wallet containing a bank card and RM300 at Jalan Bukit Pantai, Brickfields here at 12.30 am on Nov 10, 2016.

They were charged under  Section 395 of the Penal Code, read together with Section 34 of the same law, which provided an imprisonment for up to 20 years and whipping, if found guilty.

Deputy public prosecutor Aznika Mohd Anas prosecuted, while the twins were represented by lawyers Muhamad Razman Sahat and Muhammad Amin Abdullah. —  Bernama
