Two years and six months’ jail for drug abuse and causing hurt

SIBU: A man, 45, was ordered to stay in jail for two years and six months for drug abuse and voluntarily causing hurt.

The first charge against Ting Lid Wei was filed under Section 15(1)(a) of the Dangerous Drug Act 1952 and punishable under Section 15(1)(a) of the same Act.

It provides for a fine not exceeding RM5,000 or a jail term not exceeding two years and shall immediately after having undergone the jail term, undergo supervision for a period of not less than two years but not over three years.

According to the charge sheet, Ting was found to have consumed Amphetamine and Methamphetamine at 12.55pm on Sept 25, 2017 at Sungai Merah Police Station following a urine test.

Deputy Registrar Stella Augustine Druce sentenced him to one year and six months’ jail.

The second charge against Ting was filed under Section 323 of the Penal Code, read together with Section 326A of the Penal Code.

It carries a maximum jail term of one year or with a fine which may extend to RM2,000 or with both.

Ting caused hurt to his mother between 7am and 9am on Aug 2 at a house in Lan Lan Road, Sungai Sadit.

While his mother was sweeping the floor at 7am, Ting came and kicked her in the waist and again at 9am, he hit her on the head with his hand.

Ting pleaded guilty to the charge and was sentenced to one year’s jail.

The sentences are to run consecutively.

In passing the sentence, Stella said she had considered all the relevant factors with maximum evaluation including the accused guilty plea, public interest and the accused previous conviction.

“Despite convicted for drugs offence, the accused had also committed an offence under Section 323 of the Penal Code beating his own mother, which the court found to be a very serious offence.

“I also take into consideration the fact that his mother applied for an interim protection order which was granted by a magistrate on Aug 8.

“The court believes that the accused deserves a deterrent sentence and should be kept away to avoid any further abuse of his mother,” Stella said.
