Warrant of arrest issued against accused for no-show in court

MIRI: A magistrate’s court here yesterday issued a warrant of arrest against a man charged with reckless driving and causing fatal accident.

The case was set for mention yesterday but the accused Johnson Edward Empati, 34, failed to turn up in court.

The warrant of arrest was issued by Magistrate Zuraini Ali Musa after allowing an application by prosecuting officer Insp Mohd Khairi Mohd Noor.

The accused was charged according to Section 41 (1) of the Road Transport Act (RTA) 1987 (No.333/87) and punishable under the same Act.

For the offence, the accused can be jailed between two and 10 years and fined between RM5,000 and RM20,000 upon conviction.

According to facts of the case, he allegedly committed the offence at 1.30pm on Jan 13, 2012 at the junction of Manong in Jalan Batu Niah here when driving a four-wheel-drive vehicle.

The court ordered the warrant of arrest against the accused to be returned by Dec 6.

Meanwhile in an unrelated case, a warrant of arrest was issued against another driver after he failed to turn up in court for the mention of his case yesterday.

Fary Florey Nyamar faced a charge of driving a four-wheel-drive vehicle in a drunken state and failed to control his vehicle, thus causing a fatal accident.

He allegedly committed the offence at 11.40pm on Oct 15, 2016 in Jalan Pujut Padang Kerbau here.

He was charged under Section 44 (1) (a ) RTA 1987 and punishable under the same Act.

For the offence, he can be jailed between two and ten years and fined between RM5,000 and RM20,000 upon conviction.

The court also ordered the warrant of arrest to be returned on Dec 6.
