KOTA KINABALU: A former finalist in the Unduk Ngadau pageant representing Penampang and her husband were fined RM3,500 each, in default 12 months’ jail, by the Magistrate’s Court here yesterday for consuming drugs.
Magistrate Stephanie Sherron Abbie imposed the fines on Kimberley Joanne Majalap, 28, and her husband Mohammad Gadaffie Mohammad Pintaz, 32, after both of them pleaded guilty to charges under Section 15 (1) (a) of the Dangerous Drugs Act 1952.
The indictment carries a fine of up to RM5,000 or a jail term of up to five years, upon conviction.
The court also ordered Joanne, who was the second runner-up during the 2009 Harvest Queen or Unduk Ngadau pageant, and her husband to be placed under police supervision for two years.
Joanne was arrested at the central lockup in Kepayan after her urine tested positive for Methylenedioxy (MDA), 3,4-Methylenedioxymethamphetamine (MDMA) on March 1.
Meanwhile, Mohammad Gadaffie, who is a businessman, was apprehended for consuming ketamine in the room of an entertainment outlet at Karamunsing Capital here on March 2.
In mitigation, counsel PJ Perira, who represented both the accused persons, requested that non-custodial sentences be imposed on his clients since Joanne is taking care of her child.
The counsel also submitted that his clients had saved tremendous court’s time by pleading guilty to their charges plus the duo had no previous conviction and had given full cooperation with the police during investigation of their cases.
Prosecuting officer Inspector [email protected] Stephanie Kupit prayed for deterrent sentences to be given on the accused persons.
