Man claims trial to drug possession

MIRI: A man pleaded not guilty in a magistrate’s court here yesterday on the charge of being in possession of dangerous drugs, methamphetamine and ketamine.

Tan Hock Cheh, 25, from Lorong 9 Taman Tunku here is facing two charges – one under Section 12 (2) of the Dangerous Drugs Act 1952 punishable under Section 39A(1) and another charge under Section 12 (2) of the Dangerous Drugs Act 1952 punishable under Section 12 (3) of the same act.

Section 39A(1) provides for a jail term of two to five years and three to nine strokes of the cane, upon conviction.

Meanwhile, Section 12 (3) carries a jail term of up to five years or fine up to RM100,000 or both upon conviction.

Based on the first charge, Tan is accused of being in possession of methamphetamine weighing 24.91 grams. He allegedly committed the offence at 6am on April 18 this year in a house at Lite Avenue Jalan Sze Chuan 2, off Jalan Airport here.

For the second charge, he is accused of being in possession of ketamine weighing 0.83 grams. He allegedly committed the offence at the same time and place with the first charge.

Earlier, prosecuting officer Insp Mohd Khairi Mohd Noor applied for a new date to be set for the case management as the accused pleaded not guilty and claimed trial.

Magistrate Md Syafique Md Hilmie then set July 2 for case management.

The accused was released on RM4,500-bail with two local sureties while awaiting the trial date.
