Tribunal fines developers for late delivery of houses

SIBU: A developer was ordered by the Sarawak Housing Purchaser Claims Tribunal to pay RM18,877.81 to a house buyer for late delivery of properties.

Tribunal President Peter Lim yesterday morning gave the order to the developer to make the payment to the claimant Nayah Enggu and to rectify any defects to the claimant’s house within 45 days starting yesterday.

The developer fails to do so he could be fined of not exceeding RM5,000 or jailed not exceeding two years or both under Section 53(1) of the Housing Development (Control and Licensing) Ordinance 2013 if .

Nayah signed the sales and purchase agreement of the RM360,000 single storey semi detached house on Jun 16, 2015.

The house was only handed over to her on May 21, 2019 after the occupation permit (OP) was issued on April 8, 2019.

The developer explained to the tribunal that the delay was due to bad weather which hampered the construction.

Meanwhile, Lim also ordered another developer to pay a total of RM6,510 to Evelyn Minggu for the late delivery of properties.

The developer was also ordered to pay within 45 days starting yesterday.

Evelyn signed the sales and purchase agreement of the RM50,400 low cost single storey terrace house at Seduan Land District on Nov 12, 2014.

The house was only handed over to her on Oct 10, 2018 after the OP was issued on Sept 3, 2018.
