Man accused of raping girlfriend’s daughter told to enter defence

KOTA KINABALU: 43-year-old man was ordered to enter his defence on a charge of raping his girlfriend’s daughter.

Sessions Court Judge Elsie Primus made the order on Yong Siew Fui, after she ruled that the prosecution had established a prima facie case against the accused on the said charge.

The ruling was meted out yesterday and the case continued in defence stage which Yong, who was not represented, testified under oath as the first defence witness.

He is charged with raping the girl in a rented room in Bandar Baru Penampang at midnight on May 17, 2018.

The alleged offence is framed under Section 376(2)(d) of the Penal Code, which carries a jail term of between 10 and 30 years, and whipping, upon conviction.

Trial in defence stage will continue on November 15 this year.

The prosecution had called eight witnesses during the trial.

Yong is currently serving a sentence in Labuan for another offence.
