Headmaster charged with misusing his position

SANDAKAN: A 50-year-old headmaster of a primary school in Beluran was charged with misusing his position for gratification in a court here yesterday.

But the father of five pleaded not guilty to three charges of misusing his position between January and June 2015 involving RM16,378.

The offence falls under Section 23 (1) of Malaysian Anti-Corruption Commission Act 2009, which is punishable under Section 24 (1) of the same Act that provides for maximum 20 years of imprisonment and a fine of at least five times the amount of money involved or RM10,000, whichever is higher, upon conviction.

According to the charges, the accused had allegedly used his position as headmaster to appoint a stationery supplier company that is owned by his sister-in-law to supply equipment to his school.

Judge Abu Bakar Manat set March 19, 2020 for case management and the accused was allowed RM10,000 bail with RM8,000 deposited and two local sureties.

The court also ordered the accused to surrender his international passport to the court and report to Malaysian Anti-Corruption Commission office in Sandakan once in three months, and not to approach any witnesses before the case management date.

The case was prosecuted by MACC Prosecuting Officer, Mohd Faliq Basiruddin, while the accused was represented by counsel Marzuki Spawi.
