MIRI: Two men charged with murdering a mechanic in Desa Senadin three years ago were discharged and acquitted by the High Court here yesterday.
Judge Dean Wayne Daly ruled that the prosecution had failed to establish a prima facie case against Elvis Reynoldo Arit, 28, and Michael Dunggau, 29.
The two were charged under Section 302 of the Penal Code, read together with Section 34 of the same Code, which provides for the mandatory death sentence upon conviction.
Based on the amended charge, they were accused of causing the death of Fadrick Lukas, 18, at an area between Lot 2563 and Lot 2564 in Desa Senadin Phase 2, between 10.15pm and 10.45pm of June 14, 2017.
A total of 24 witnesses testified throughout the proceedings.
DPP Mohd Fillanny Siji prosecuted.
The two accused were represented by Ranbir Singh and Gurvir Singh.
