Man jailed six years, whipped for robbery

SIBU: A man, 40, was sentenced to six years’ jail and one stroke of the cane by the Sessions Court yesterday after he pleaded guilty to a robbery charge.

Lu Tung Wu was charged under Section 392 of the Penal Code which provides for 14 years’ jail and also liable to a fine or whipping on conviction.

Lu was then brought to a magistrate’s court to face two other charges where he pleaded guilty to wrongful confinement and failing to provide an identification document during an inspection.

The wrongful confinement charge was framed under Section 342 of the Penal Code which provides for a jail term that may extend to a year, or a maximum fine of RM2,000 or both upon conviction.

For failure to provide an identification document it was framed under Regulations 25(1)(n) National Registration Regulations 1990 which carries a maximum three years’ jail or a fine not more than RM20,000 or both upon conviction.

For the offences, he was sentenced to 10 months and two months’ jail for the respective charges.

The sentences run concurrently.

According to the fact of case, Anatasia Marcus, 31, was waiting for her employer Dennis Wong, 27, in her car at Chengal Road at 1.05pm on Sept 10 when suddenly Lu entered the car and drove it away without her consent.

Anatasia told him to stop so that she could get out, but it was ignored.

She then tried to seek help through phone call but the accused took her phone away.

She then shouted for help through the car window.  The accused then stopped at Kampung Nyabor Road.

She got out of the car and ran to a police station nearby.

In trying to escape, Lu accidentally hit a road divider near the police station.

He was arrested at 1.20pm.

He failed to provide identification document when inspected by the police.
