KUCHING (July 9): The Magistrates’ Court here today transferred the Jalan Stephen Yong fatal shooting case involving Bukit Aman traffic police officer L/Cpl Genesis Nitchell David Reddy to the High Court.
Magistrate Ling Hui Chuan issued the order after allowing the application by deputy public prosecutor Adriana Maisarah Mohd Farid to transfer the case against Genesis, 30, to the High Court.
During proceedings, Ling was also informed by the prosecution that a key document in the case, namely the post-mortem report, had been obtained.
Genesis was also ordered to remain in custody at Puncak Borneo Prison while awaiting a mention date to be set by the High Court.
On May 7, Genesis was charged in the Magistrates’ Court under Section 302 of the Penal Code, which carries the death penalty, or if not sentenced to death, imprisonment for a term of between 30 and 40 years and no fewer than 12 strokes of the cane, upon conviction.
He is accused of murdering Muhammad Zaki Iderus, 34, by shooting him on Jalan Stephen Yong here in April.
Genesis is represented by lawyers Russell Lim Brendan Ting and Zoe Chan from the National Legal Aid Foundation.
According to earlier reports, on April 26, two men arrived at the Batu Kawa Police Station around 5.30am and informed police that their friend had been shot while travelling on Jalan Stephen Yong, Batu Kawa.
Police later found the victim dead from a gunshot wound to the head.
