Foreign man jailed for distributing illegal DVDs

KOTA KINABALU: A man will spend 10 months behind bars for distributing 106 illegal DVD’s.

Haris Habidin, 26, was also odered by magistrate Mohd Faiz Omar to be referred to the Immigration Department once he has completed his sentence.

Haris was detained during “Ops Pocket” on October 10 this year at a foodstall here at 6:30pm where officers had detained him for being in possession of various CD’s and DVD’s.

The indictment is framed under Section 18(4), and punishable under Section 18(5) of the Film Ceonsorship Act 2002 which carries a maximum RM30,000 fine or a jail term not exceeding three years.

In mitigation, the unrepresented Haris pleaded for a light sentence and asked for the prison sentence to run from date of his arrest.

However, prosecuting officer Inspector Syahrin Ali urged the court to mete out a heavy sentence, and added that Hartis should be referred to the Immigration Department as he did not have any proper documentation.

In a separate case, eight men were charged with consumption of drugs by the same court here yesterday.

No plea was taken from Patrick Molukun, 45, Rusli Durahim, 38, Nadsri Arsad, 19, Johan Haral, 28, Mohd Hafizan Ajin, 28, Mohammad Sagga Ben, 22, William Ayae, 34, and Faisal Ijabm, 30.

Their offence is framed under Section 15 of the Dangerous Drug Act 1952 and is punishable with a fine not exceeding RM5,000 or a maximum prison term of two years.

Another man was also jointly charged with having 0.05 grams of syabu (methemphetamine) in his possession, an offence framed under Section 12 of the same act, and can be fined up to RM100,000 or imprisoned for no longer than five years, or both, upon conviction.
