KOTA KINABALU: An incest trial at the Sessions Court here was told yesterday that a former policeman allegedly forced his daughter to take pills if she became pregnant.

A 14-year-old witness said this to court judge M Raja Lingam on the first day hearing of  58-year-old ex-policeman charged with committing incest with his  daughter, aged 14, during the school holidays in December 2009 in Kota Marudu.

The father is charged under Section 376 (3) of the Penal Code which provides for a  maximum 30 years’ jail and whipping, on conviction.

Deputy public prosecutor Effizah Ernie Idris called the alleged victim’s schoolmate as the first prosecution witness to testify against the former policeman who is defended by counsel Hamid Ismail.

In her testimony, the witness said she was informed by the alleged victim that the latter was forced by the father to take pills if she became pregnant.

She said the father forced the alleged victim, who was staying with her grandmother during the school holidays, to return as he was alone at home.

“When we met in school, she (the victim) told me that her father ‘did it’ while they were on their way from Kota Belud,” said the witness.

Asked by Effizah if she understood the meaning of ‘did it’, the witness replied in the affirmative, saying that the father raped his daughter.

“She (the victim) told me through SMSes that she had a problem, but was afraid to tell me as her father might beat her,” said the witness, adding that she forced the victim to tell what her (the victim’s) exact problem was.

“I said to her (the victim): ‘Please tell me your problem so I can help you,’ to which the victim later told me that her father had raped her,” said the witness who has known the alleged victim since two years ago.

To a question from Effizah, the witness said the alleged victim’s father was present in the courtroom.

She said the first time she met the alleged victim’s father was at the latter’s home when she (alleged victim) introduced her to him.

The accused is currently released on bail of RM4,000 deposited with two local sureties. Hearing continues today.
