Twins in assault case claim trial

KUCHING: Two twin brothers charged with assaulting and intimidating a woman claimed trial in the Magistrates’ Court here yesterday.

Patmaviran Kalimuthu and Thanasegaram Kalimuthu, 20, appeared before Magistrate Portia Tham Ong Leng who released them on RM1,000 cash bail each with two sureties, pending their trial on Nov 3 to 4. The pretrial case management was set on Oct 7.

Patmaviran faces two charges of assaulting the complainant by slapping her shoulder twice and uttering harsh words while Thanasegaram shoved a penknife at her, threatening to hurt her if he ever saw her around again.

They allegedly committed the offence at a petrol station at Rock Road at 2.30pm on Sept 14.

Assault comes under Section 323 of the Penal Code which carries a maximum one year in jail or fine or both, while intimidation comes under Section 506 of the Penal Code and they could be sentenced up to seven years in jail, fined or both upon conviction.

The complainant was at the petrol station when the twins approached her; one of them slapped her back and the other shoved the penknife at her.    Frightened, the complainant managed to escape from the brothers.

Chief Inspector Austin Patrick Angkon appeared for the prosecution while both accused were not represented.

In another court room, a drug store owner was fined RM1,500 in default two weeks’ imprisonment for selling unregistered medicines.

Sessions Court Judge Timothy Finlayson Joel fined the accused, surnamed Thong, after he pleaded guilty to the charge framed under Section Rule 30(1) of Control and Drugs and Cosmetics Regulations 1984.

Thong admitted to having in his possession 33 boxes of Red Yeast Plus – a product not registered with the authority.

He committed the offence at his premises near a shopping mall here at 2.40p on Jan 17, 2009.
