KUCHING: Two youths accused of raping a girl have pleaded not guilty to the two charges brought against each of them at the Sessions Court here.
Christnel Dave Ulis, 20, of Kampung Panchor Dayak Batu 27 near the old Kuching-Serian Road, was told yesterday that his pre-trial case management date would be on Jan 28. He was also advised by the judge to engage a counsel.
The other accused, Ariffin Aini, 19, of Kampung Chupak Batu 24, also near the old Kuching-Serian Road, was released on cash bail of RM5,000 with one surety with a permanent address here. Under the condition, he would be required to report to the nearest police station once a month pending the disposal of the case.
Pre-trial case management date for Ariffin is Feb 26.
It is said that the duo committed the dastardly act on the 14-year-old girl inside a hut near a paddy field in Kampung Panchor Dayak around 9pm on Jan 2.
For this charge under Section 376 of the Penal Code, the two could face imprisonment of not less than five years and not more than 30, with a possibility of whipping, if convicted.
The duo was also accused of forcing oral sex onto the victim – an offence punishable under Section 377C of the Penal Code, which provides a jail term of not less than five years and not more than 20, with a possibility of whipping, if found guilty.
